Will There Be a Problem Using a 70 Amp Breaker for a 50 Amp Rated EV Charger?

A user asked the app whether a 70 amp breaker can feed an EV charger rated at 50 amps. The short answer is yes there is a problem, and it is a Code violation on more than one count under NEC 2023. The breaker does not just feed the circuit, it protects everything downstream, and everything downstream here is rated for 50 amps or less.

What Article 625 requires

EV charging equipment is a continuous load by definition under Section 625.41, so the branch circuit must be sized at 125 percent of the maximum load of the equipment. A charger that draws 40 amps continuous needs a circuit rated at least 50 amps. That sets the minimum. The maximum is set by the equipment itself: Section 110.3(B) requires installation per the manufacturer instructions, and every listed EVSE specifies the maximum overcurrent device allowed, typically 50 amps for a 40 amp unit. A 70 amp breaker exceeds that listing and voids the protection scheme the manufacturer designed around.

If the charger is cord and plug connected on a NEMA 14-50, the violation doubles. Table 210.21(B)(3) caps a 50 amp receptacle at a 50 amp circuit. A 70 amp breaker behind a 50 amp receptacle means a fault inside the receptacle or the cord could cook the device without ever tripping the breaker. The conductors matter too: a 70 amp circuit requires 4 AWG copper at 75 degrees C, and if the existing wire is 6 AWG sized for 50 amps, the 70 amp breaker leaves it unprotected.

The right way to get headroom

Installers sometimes reach for a bigger breaker hoping to future proof for a larger charger. The compliant route is to size the whole circuit for the future load: 4 AWG conductors, a 60 or 70 amp breaker, and a hardwired EVSE rated for that circuit. Many chargers have adjustable current settings, and Section 625.42 allows sizing to the adjusted setting when the adjustment is restricted behind a cover or password. Match breaker, wire, receptacle, and charger as one system and the inspection takes care of itself.
